1. Acceptance of Terms
By accessing or using Extractly (“the Service”), operated by Extractly (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Extractly is an AI-powered platform that extracts structured data from websites. Users provide URLs, select or create extraction templates, and receive structured data outputs in formats such as JSON and CSV. The Service supports bulk extraction jobs, API access, and Google Sheets export.
3. User Accounts
You must sign in with a Google account to access certain features. You are responsible for maintaining the security of your account and are liable for all activity under your account. You must be at least 18 years old to use the Service.
4. Credits and Billing
The Service operates on a credit-based system. Each extraction consumes credits based on the number of pages scraped and the complexity of the template. Credits are allocated monthly based on your subscription plan. Unused credits do not roll over. Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in our Refund Policy.
5. Acceptable Use
You agree not to use the Service to:
- Scrape websites that prohibit automated access in their terms or robots.txt
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of any third party
- Extract personal data in violation of privacy laws (including GDPR, CCPA)
- Overload or attack our infrastructure
- Resell or redistribute the Service without authorization
6. Intellectual Property
The Service, including all code, design, templates, and documentation, is owned by Extractly. You retain ownership of the data you extract using the Service. By using the Service, you grant us a limited license to process your extraction requests and store results for your retrieval.
7. Third-Party Services
The Service integrates with third-party providers including Google (OAuth, Sheets), Supabase (database), and AI providers (Gemini, OpenAI, Anthropic). We are not responsible for the availability or practices of these third-party services.
8. Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, Extractly SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. You may stop using the Service at any time. Upon termination, your right to access extracted data may be limited. Provisions that by their nature should survive termination will survive.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
11. Governing Law
These Terms are governed by the laws applicable to the jurisdiction in which Extractly operates. Any disputes shall be resolved through binding arbitration where permitted.
